You lucky, lucky people - right here we don’t just have a single remake we have two of the blighters lined up just for you. Danjo of ACODERS has been a busy bee and just informed us of his Asteroids and Lunar Lander games, both with a decidedly thrusty bent.

Both games are entries into the “20 Event Competition” that Clickteam are currently holding, where a game has to be created within heavy restrictions, which always tends to bring the best out people, or at least get them thinking outside the box.

Case: CBC v. Major League Baseball

C.B.C. Distribution and Marketing, Inc. v. Major League Baseball Advanced Media, L.P., et al.

In a much watched case, on October 16, 2007, the United States Court of Appeals for the Eighth Circuit decided C.B.C. Distribution and Marketing, Inc. v. Major League Baseball Advanced Media, L.P., et al., regarding whether it is ok for fantasy sports operators to use professional athletes’ names and historical statistics without a license from the players, the players association and/or the relevant league. In this case, the sport is baseball, but the ruling can be applied across the board to any fantasy sports league. In this case, the Eighth Circuit held that C.B.C. Distribution and Marketing, Inc. (“CBC”), a provider of online fantasy baseball products, could use the names of and statistics of Major League Baseball (“MLB”) players without a license from Major League Baseball Advanced Media, L.P. (“Advanced Media”), a MLB holding company to whom The Major League Baseball Players Association (“the Players Association”) had granted the exclusive right “to use baseball players’ names and performance information ‘for exploitation via all interactive media.’” Slip. Op. at 3. MLB and Advanced Media unsuccessfully argued that CBC’s use of player names and statistics was a violation of the players’ rights of publicity, copyright infringement, and breach of contract, among other theories. The court held that the fantasy sports operator’s actions were protected under the First Amendment.

In 1995, the Players Association first granted CBC a license to use the names of MLB players and their corresponding statistics in fantasy baseball games. In 2002, the Players Association granted CBC a renewed license, which gave CBC the rights to use “the names, nicknames, likenesses, signatures, pictures, playing records, and/or biographical data of each player” in connection with CBC’s fantasy baseball products. Slip. Op. at 3. When this renewed license expired in 2005, however, the Players Association did not grant CBC another renewed license. Instead, the Players Association granted the exclusive right “to use baseball players’ names and performance information ‘for exploitation via all interactive media’” to Advanced Media (the MLB holding company mentioned above). Id. After Advanced Media received this exclusive license from the Players Association, it approached CBC and proposed a license under which CBC could promote fantasy baseball games on MLB.com, but could not continue offering its own fantasy baseball products. CBC subsequently brought this declaratory judgment lawsuit, seeking a court decree that it could continue to use the names of and statistics related to MLB players without a license from Advanced Media.

At issue in this case was whether MLB could exercise exclusive control over the fantasy baseball business by limiting others’ access to factual player information (i.e., names and statistics). In order to exercise this control, MLB, acting through the Players Association and Advanced Media, tried to establish that CBC’s use of the names of MLB players and their corresponding statistics violated rights of publicity, was copyright infringement, and was a breach of the previous licensing contract. At the trial court level, MLB argued that CBC was violating the baseball players’ individual rights of publicity, which are protected under state law (Missouri state law in this case, pursuant to federal jurisdictional rules). Although the trial court held that MLB failed to establish these state-law rights, the Eighth Circuit reversed this determination and found that state-law rights of publicity were implicated. However, the Eighth Circuit further held that First Amendment considerations (i.e., the “right to use information that is available to everyone”) trumped these state-law rights. Significantly, in deciding that these state-law rights “must give way” to First Amendment considerations, the Eighth Circuit characterized the baseball players’ names and their corresponding statistics as information that is “readily available in the public domain.” Slip. Op. at 7. Because MLB (or anyone else for that matter) cannot exercise exclusive control over information in the public domain, the Eighth Circuit affirmed the trial court’s judgment in favor of CBC, thus allowing CBC to continue using MLB players’ names and statistics without a license.

(Earlier in the case, MLB and Advanced Media also tried to argue that the use of player names and statistics was an infringement of one or more copyrights owned by MLB. MLB argued that it owned a copyright in the compilation of names and statistics. The court didn’t buy it and indicated that the names and statistics were public domain factual information.)

So for those of you running your own fantasy sports sites (or at least fantasy baseball sites), the decision in this case means that you can make use of the same information as CBC (i.e., player names and statistics) without obtaining a license from the relevant professional sports league. However, you should still consult a lawyer regarding your particular situation, because the ruling in this case involves some complicated interactions between state and federal law, and perhaps could have been decided differently by a different court with respect to the rights of publicity issues.

Infamous/Ovine Soundtrack

Gah! I’d forget my own brain if it wasn’t screwed into place, I was meant to post this earlier in the week and wandered off bemused as usual. Ah well… as per the title, this is the soundtrack release of Infamous’ work for the nice chaps at Ovine By Design.

The first in a series of 3 planned releases (we may push to more, we shall see how well this one goes), the Infamous/Ovine soundtrack was generously donated to the “help RR” fund (the one that tries to help us get this website balancing its books a bit) by the uber talented Chris Bailey, Smila and Ovine with thanks to Chris Abbott of C64 Audio along the way.

12 tracks of rather fine remakey musical goodness taken from some of the best remakes around are but a click away from your nimble fingers. Featuring sounds from Driller, Dan Dare, Hunters Moon and Ovine’s very own Quantasm (I still keep misreading the last one, but that’s a story for another day).

All tracks are available in 320kbps mp3 or high quality wma files for your listening pleasure (sorry, I’ve got no access to the raw files so flac is out of the question chaps - besides, it’d murder our bandwidth… ) and complete with some fetching cover art designed by Smila.

Rather than faff around with a pay through service as we originally planned , we decided to place it out there in the open as a digital download that’s absolutely free to snaffle, share and enjoy. However, if you do download and enjoy it - we’d appreciate it if you could drop even the smallest donation in the pot by way of a thank you and to encourage us to keep adding more exciting (!) content over the coming months. All donations just get bunged into paying to keep this place online, so fear not - we’re not likely to run off to Barbados. (Oh, if only…)

A Few Tidbits About WoTLK - 5 Mans and DK Creation

CM’s Bornakk and Nethaera give us a little something about the Wrath of the Lich King expansion and I figured they are probably stuff you guys would like to know. Bornakk tells us something about the 5 man dungeons while Nethaera clarifies how Death Knight creation and server transfers are going to work.

WotLK 5 man Dungeons

We are currently planning to keep the 5 person dungeons in Wrath of the Lich King fairly short in length, but with a boost to their overall epicness - the preview we have of The Nexus is a great example of this.

The more vast and sprawling dungeons will be found in the raid dungeons which more players will be able to experience with the changes to the setup. Source

Death Knight Creation and Server Transfer

An online poster in the official forums wrote this:

Bornak (I think) clarified that if a server is not yet open to transfers, then you need a level 55 on that server to create a Death Knight. Once it’s open to transfers, though, it’s fair game.

Nethaera replied:

This is correct. At this point in time, we don’t have any further limitations on the creation. As always, I like to give a caveat that this could change if we feel it’s necessary.

It’s good to hear that the 5 man dungeons of the next expansion won’t.be too long. It’s not that fun if a dungeon takes so long to finish. Dungeon length sometimes factors into whether or not someone can do the dungeon. Many times, I’ve been turned off by Botanica runs since it’s pretty long.

Hey you Pikachu? A look at Super Pikachu Brothers

While the Pokemon franchise is immensely popular Nintendo has yet throw any of their cuddly creatures into a proper platformer. However, some pirate company did and created Pka Chu. I got a chance to play the pirate ROM, which is essentially a sprite swap of Super Mario Brothers.

When Pikachu, or Pka Chu drinks the potion…

… he looks more like Nintendo’s creation. However, Pikachu doesn’t throw lightning after getting a second power up. He lobs fireballs just like fire flower powered Mario.

Instead of Bowser a fire-breathing, mecha lizard is waiting inside the castle protecting the “princess”. Very amusing.

Why I trust GameTrailers’s Haze review

GameTrailers has finally given its two-cents’ worth on Haze, a PS3-exclusive shooter that hasn’t been doing very well in the reviews department. Among the verdicts you’ll see, this video is perhaps one of the more grounded.

There were scathing ones, like that of IGN’s, which focused more on lambasting the game’s story and characters instead of the more important part (i.e. the gameplay). Since when was a shooter’s narrative expected to equal or surpass that of an Oscar-quality film?

The GameTrailers review took into account Haze’s semi-good parts (as any criticism should) and discussed why the universally-agreed atrocious parts (like the repetitive voice work) were appalling. The most noticeable fault leveled by reviewers against Haze is that the game is “generic.” Sounds like what I said about the game last year.

The GameTrailers clip was one of the later reviews that came out. Incidentally, IGN’s article was one of the first. I guess this says something about the so-called timeliness and accuracy of reviews. A word of advice: If a site comes out with the first review, take it with a grain of salt. A review coming out on launch day could mean it was rushed, or that the critics played the game in optimal conditions (i.e. a publisher’s posh office with good food and lag-free multiplayer). Either way, you might be reading an inaccurate analysis.

Super NES Wii Controller, Worth Your Buck For SNES Gaming

The Super NES Wii controller doesn’t come cheap (the owner bought it for around 40 to 50 bucks on eBay). But overall, the retro feel of a Super NES controller is there. Plug it into any VC games such as Super Mario or Street Fighter, and you’ll be instantly transported back to the Super NES era. You know what I mean.

PS3 Guitar Hero III getting free God of War track in June [update]

With Xbox 360 players getting a Halo 3 musical number for free last Thanksgiving, the gods of rock have now smiled down on PS3 owners as well. Tucked away in the latest PlayStation Underground newsletter comes word that PS3 armchair rockers will be able to download a free God of War-themed track for Guitar Hero III to rock out to on Thursday, June 5.

No other details have been revealed, including what selection exactly will be released. Even so, free is free, though honestly we’re racking our brains trying to come up with a single piece of God of War music that’s memorable enough to warrant a living room encore.

Case Update: Lonestar v. Nintendo (E.D.Tex.)

Lonestar Inventions LP v. Nintendo of America Inc., case no. 6:07-cv-00261 in the U.S. District Court for the Eastern District of Texas.

This lawsuit between patent-holding company Lonestar Inventions LP and gaming conglomerate Nintendo Inc. will play out in mediation after a federal judge ordered the two companies to try their case before a mediator on Thursday, Dec, 13, 2007. Texas-based Lonestar first sued Nintendo in June, alleging that the company’s popular Wii video game console infringed on a patent titled “High capacitance structure in a semiconductor device.”

Another Wheel For Your Wii, With Stand

After Mario Kart Wii, everything seems to be wheelized. Wheels for the Wii just pop up like mushrooms everywhere. Looking at the cover, I thought we got a Disney’s Cars game with a driving wheel but there’s only a white driving wheel (plus a stand) inside. Not very impressive. $19.99 if you want to add more wheels to your Wii treasure trove.
